ULTIMATE TMN SUPERFAN CONTEST OFFICIAL RULES
How to enter:
1.Website. To enter, visit www.tmnsuperfan.ca, become a user clicking on the Upload Your Video Now button, completing the registration form and uploading your unique and original video submission or photograph telling us why you are the Ultimate TMN Superfan. Registration information required includes your first name, last name, city, province, e-mail address, age range, and telephone number. Every eligible video or photograph uploaded counts as one (1) entry into the respective weekly and final Grand Prize draws. The contest runs from 10:00am on Friday, June 19, 2009 to Thursday, August 20, 2009 at 4:59pm ET (the "Contest Period") By entering this contest and submitting your video or photograph, you agree that other users may post comments about your video or photographs content, and to express their like or dislike of the content by voting 'super or not'. All users posting comments or voting will be registered and comments are moderated for offensive or inappropriate content prior to upload. Votes and comments submitted by other users in connection with the video or photograph submissions shall in no way determine the contest winners. By entering the contest, entrants hereby grant The Movie Network the unlimited licence and right to use, publish, display and exploit the video and photograph submissions without compensation or notice, in perpetuity, in any and all media now known or hereafter devised, including without limitation on The Movie Network's television service and/or website, and/or in any publicity, promotion or programming for The Movie Network and/or its affiliated services. The rights granted to The Movie Network herein include, without limitation, the right to record, tape, reuse, display, distribute, transmit, alter, modify and/or edit without restriction, and/or otherwise exploit the video submissions. The Movie Network reserves the right in its sole and absolute discretion, to moderate, reject, or disqualify any video submission for any reason, including but not limited to deeming a video submission offensive or inappropriate. By entering this contest, all entrants fully discharge, release and indemnify The Movie Network and any of its respective affiliates, subsidiaries, assigns, successors, directors, officers, employees, agents, representatives and advertising and promotional agencies (collectively, the "Releasees"), from any and all claims, demands, damages, actions or causes of action whatsoever in connection with the use of the video or photograph submissions, and further acknowledge that the Releasees will not be responsible for any injury, accident or any other loss, damage, expense or misfortune relating to the use of the video or photograph submissions. By entering this contest, all entrants acknowledge and confirm that they control all rights necessary to grant the rights and consent to the use of the video and photograph submissions and that no other person has any intellectual property rights in the video or photo submissions. Entrants hereby waive any moral rights in and to the video or photograph submissions and understand that The Movie Network will own all the rights to the original video or photograph submission.

All contest entries are eligible for both the Grand and Secondary prizes. An entrant must have reached the age of majority in their province of residence in order to enter the contest. Proof of identification must be provided upon request, if proof of identification cannot be obtained then the entry will be disqualified. The contact information collected by The Movie Network with your entry will only be used to award the contest prizes. The Movie Network will not use this personal information for any other reason and will not otherwise disclose this personal information to any other party. . NO PURCHASE IS NECESSARY. All entries are the property of The Movie Network and will not be returned. All mail entries must be received by no later than Thursday, August 20, 2009 at 4:59pm ET.
Eligibility:
The contest is open to permanent lawful residents of Ontario, New Brunswick, Prince Edward Island, Nova Scotia, Newfoundland and Labrador only, who have reached the age of majority as of the date of entering the contest, excluding employees (and their immediate The Movie Network members or persons with whom they are domiciled) of Astral Television Networks and their respective member companies, affiliates and subsidiaries, and advertising and promotional agencies. The contest is subject to all applicable federal, provincial and municipal laws and regulations. Contest void where prohibited by law. The Movie Network reserves the right to cancel or suspend this contest in the event of any accident, or administrative or other error of any kind. Entries must be uploaded or received by post at The Movie Network no later than Thursday, August 20, 2009 at 4:59pm ET. The Movie Network takes no responsibility for entries that are lost, misdirected, delayed, incomplete, unsuccessfully uploaded, garbled or received after the contest deadline. Limit of one (1) entry per person per day. In the event that The Movie Network receives more than one (1) entry per person, The Movie Network reserves the right to void and destroy duplicate entries and that entrant may, at the sole discretion of The Movie Network, be disqualified from the Contest. Should it be discovered that an entrant is using the aid of computer programs to auto-fill entries, that entrant will be immediately disqualified from the Contest. The Movie Network reserves the right to disqualify all such contestants from future contests conducted by the The Movie Network without further notice. By submitting a contest entry, participants agree to be bound by these rules. In the event of a dispute as to the identity of a winner based on an e-mail address, the winning entry will be deemed to be made by the authorized account holder of the e-mail address at the time of entry. The authorized account holder is the natural person who is assigned an e-mail address by an Internet service provider or other organization responsible for assigning e-mail addresses for the domain associated with the e-mail address in question.The Draws:
Votes submitted by other users in connection with the videos, will in no way determine who the winner of the contest shall be. The winner of the contest shall be determined by a random draw, as described herein.. Secondary Prize: One (1) random draw will be held weekly over the course of the nine (9) week Contest Period at, or around 10:00 AM ET, at TMN’s Toronto office located at 181 Bay Street as per the detailed schedule below. The chances of being selected to win a secondary prize in this contest depend on the total number of eligible entries received that week.Contest

Grand Prize: There will be one (1) Grand Prize draw held at or around 11:00AM ET, at TMN’s Toronto office located at 181 Bay Street. The chances of being selected to win the Grand Prize in this contest depend on the total number of eligible entries received during the nine (9) week Contest Period.
Prizes:
Secondary Prizes: There are nine (9) Secondary Prizes to be won consisting of - Secondary DVD prize packs of select programming currently airing on The Movie Network. DVDs offered will vary on a weekly basis and are selected at the sole discretion of The Movie Network who reserve the right to substitute any portion of the weekly secondary prize package with a prize of equivalent or greater value. (approximate retail value: up to $100 CAD) Grand Prize Package: There is one (1) Grand Prize Package to be won consisting of: - A trip for 2 to a red carpet premiere;- Airfare for two (2) from the major airport nearest to the winner’s home address to the location of the premiere - 4 day/3 night accommodation (based on double occupancy) at a minimum 4 star hotel near the location of the premiere - C$500 spending money Approximate Retail Value of the Grand Prize is CDN $ 5000. The winners will be responsible for obtaining any required travel and health documents (which must be valid prior to and for the entire duration of the trip), transportation to and from the departure airport or other departure location (ground transportation), gratuities, applicable taxes, travel insurance incidentals and all other expenses not specifically mentioned above. All costs and expenses not specifically included above as part of each Grand Prize including, without limitation, cancellation fees, taxes, departure taxes, other travel related taxes and fees, duties and levies, meals, telephone charges, other room charges, incidental expenses, medical expenses and other items of a personal nature, additional optional excursions, gratuities and insurance, are the sole responsibility of each Grand Prize Winner and his/her guest. All travel documentation is the responsibility of each Grand Prize Winner and his/her guest and Grand Prize will be forfeited if such documentation is not provided. Reservations will be arranged through the The Movie Network. Dates of travel may not be changed, except by The Movie Network. Lost or stolen tickets and travel vouchers will not be replaced. The Grand Prize Winner and his/her guest must travel together and depart from and return to the commercial airport nearest to the Grand Prize Winner’s residence in Canada serviced by the airline selected by The Movie Network. It is strongly recommended that the Grand Prize Winner and his/her guest purchase independent travel insurance for medical, accident and baggage coverage.
Acceptance of Prize
Entrants selected as winners must correctly complete a mathematical skill testing question and must sign a declaration confirming compliance with the rules and regulations and acceptance of the prize as awarded, and a release form acknowledging the non-responsibility of The Movie Network, their affiliates and/or associates and their respective agents, employees and officers and directors with regard to any injury, accident, damage, claim, liability, loss or misfortune related to any aspects of the contest, prize, the acceptance, use, misuse, possession and delivery of the prize, printing errors, claims based upon publicity rights, defamation or invasion of privacy, prior to being awarded the Prize. If a winner is a minor, his/her parent or legal guardian must sign a declaration and release form on his/her behalf in order for the winner to claim his/her prize. Selected entrants will be notified by telephone or e-mail within two (2) days of the draw. Selected entrants will then have three (3) days following receipt thereof to contact THE MOVIE NETWORK to claim their prize. Should The Movie Network not receive confirmation within three (3) days, or should a selected entrant be unable to correctly answer the skill testing question or complete a declaration and release by the date specified, the selected entrant will be deemed to have forfeited any rights to the prize and a back up entrant will be selected from the same manner by random draw taken from the same pool of entries, in which event, the foregoing provisions of this sentence shall also apply to such other eligible entry. All prize taxes, if any, are the responsibility of the winner. Limit one (1) secondary prize per person or household and one (1) Grand Prize per person or household. The Movie Network or its appointed designee shall deliver the prize to the winner where applicable. The Movie Network will not be held responsible for the loss of prizes due to changes in mailing addresses, errors in completed entry forms or any other circumstances leading to an invalid, erroneous or incomplete mailing address or e-mail address.
General
Prizes must be accepted as awarded and may not be exactly as shown. The Movie Network, in their sole discretion, reserve the right to substitute any portion of the Secondary or Grand Prize Package with a prize of equivalent or greater value. Some restrictions may apply. Prizes are non-transferable, non-refundable and have no cash value. All entries become the property of The Movie Network and will not be returned. Each entrant agrees to waive all rights with respect to print, online and broadcast publicity. By entering the contest and accepting a prize, the winner hereby consents to the reasonable use by the The Movie Network of the winner's photograph, voice, likeness and/or image, contents of the entry and the name of the winner without any further compensation for any future promotional activity. Each entrant consents and agrees to the The Movie Network’s collection and use of the information provided by the entrant for the purpose of administering this Contest. Each entrant agrees to be bound by these Contest Rules and Regulations. The Movie Network is not responsible for incorrect or inaccurate entry of registration or entry information which may affect an entrants’ inability to get through on the internet during the promotion or ability to participate in the Contest, including but not limited to human error, technical malfunctions, lost/delayed/corrupted data transmission, omission, interruption, deletion, defect, line failures of any telephone network, computer equipment, software or any combination thereof, any inability to access the site, or damage to a user's system occasioned by participating in the Contest, and entries which fail to fully comply with these Contest Rules and Regulations. The Movie Network reserves the right to cancel or suspend the contest should a virus or any other factor beyond The Movie Network’s control corrupt the security or administration of the contest. Entries are subject to verification and will be declared invalid if they are illegible, mechanically reproduced, mutilated, forged, falsified, altered or tampered with in any way. The Movie Network reserves the right, in its sole and absolute discretion to cancel, modify or suspend a contest for any reason, including without limitation in the event of any printing, administrative error, virus, bug, unauthorized human intervention or other causes beyond its control which corrupt or affect the administration, security, fairness or proper conduct of the contest. Any attempt to deliberately damage any website or to undermine the legitimate operation of this Contest is a violation of criminal and civil laws, and should such an attempt be made, The Movie Network reserves the right to seek remedies and damages to the fullest extent permitted by law, including criminal prosecution. Entries are subject to verification and will be declared invalid if they are forged, falsified, altered or tampered with in any way.
